Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you" or "Customer") and Wastewag ("Wastewag," "we," "us," or "our"), a sole proprietorship / limited liability company operating in Orange County, California. By scheduling a pickup, creating an account, paying an invoice, allowing our technicians on your property, or using wastewag.com (the "Service"), you agree to these Terms, our Privacy Policy, and any service-specific addenda. If you do not agree, do not use the Service.

You must be at least 18 years old, the legal occupant of the service property, and authorized to grant entry and waste-removal authority for everyone living at that address.

Wastewag provides scheduled dog waste removal ("scooping") and optional PoopCheck™ visual stool monitoring at residential properties in our published service area. "Visit" means a single attendance by a Wastewag technician. "Plan" means a recurring weekly or twice-weekly subscription. Pricing, frequency, and inclusions are described on the Service and may change with notice.

PoopCheck is a non-medical, non-diagnostic, technology-assisted visual observation service.Photographs collected at your property may be analyzed by automated computer-vision and large language models that estimate a numeric "poop score" and suggest general wellness commentary. Outputs are based solely on visible appearance of stool and are produced without examining your dog, performing laboratory testing, or consulting your veterinary records.

Wastewag is not a veterinarian, veterinary practice, veterinary technician, or animal-health provider. No employee, contractor, technician, AI model, or automated message we send is providing veterinary medical advice, diagnosis, treatment, prognosis, prescription, or a doctor–patient relationship of any kind. PoopCheck scores, color codes, descriptions, AI summaries, "recommendations," text messages, and email notifications are informational only and may be inaccurate, incomplete, or wrong.

You must not rely on any Wastewag output to make medical, dietary, surgical, emergency, or end-of-life decisions for any animal. If your dog appears ill, lethargic, dehydrated, in pain, has blood in stool, has ingested a foreign object, is vomiting, or you have any concern at all, contact a licensed veterinarian or an emergency animal hospital immediately. Do not delay care because of anything we told, scored, texted, emailed, or displayed to you.

You agree that any action you take or do not take in response to PoopCheck content is taken at your sole risk, and you release Wastewag from any liability for that decision to the fullest extent permitted by law (see Section 12, Limitation of Liability, and Section 13, Indemnification).

• You authorize Wastewag and its technicians to enter the gated and ungated portions of your yard during scheduled visit windows for the purpose of waste removal and photographing waste for PoopCheck.
• You will keep dogs secured indoors, kenneled, or otherwise restrained during the visit window. Wastewag may skip a visit (and still charge for it) if a dog is loose, aggressive, unrestrained, or otherwise prevents safe service.
• You represent that no dog at the property has a known history of biting, fear-aggression, or active illness (e.g., parvovirus, giardia, kennel cough) without notifying us in advance in writing.
• You are responsible for unlocking gates, disabling pet doors as needed, clearing obstructions (toys, hoses, sprinklers), and ensuring the yard is reasonably accessible.
• If we cannot safely access the yard, the visit will be marked complete-by-skip and is non-refundable.
• You agree to keep walkways and yards free of hazards. Wastewag is not responsible for pre-existing damage, dead grass, irrigation lines, hidden landscape lighting, buried pet remains, fence damage, or items concealed under foliage.

• By using PoopCheck, you grant Wastewag a perpetual, worldwide, royalty-free license to capture, store, process, analyze, and use photographs of dog waste taken at your property, in de-identified form, to operate, improve, train, and benchmark our service and our AI models.
• Photographs are stored in a private bucket and shown to you blurred by default behind a unique share link. We do not knowingly include people, faces, license plates, or house numbers in PoopCheck photos; if one appears, contact us to delete.
• AI outputs (score, analysis, recommendation) are produced by third-party model providers and may be cached, regenerated, or revised at any time. We do not guarantee continuity, accuracy, or availability of past scores.
• If you do not want photographs captured, you must opt out in writing before your next visit; opting out disables PoopCheck for your account.

By providing your phone number or email, you consent to receive transactional messages from Wastewag, including visit reminders, completion notices, PoopCheck reports, billing notices, and service alerts. Message and data rates may apply. Reply STOP to any text to unsubscribe from SMS, or use the unsubscribe link in any email. Disabling notifications does not cancel your subscription.

• Plans are billed in advance on a recurring basis (typically monthly) using the payment method on file. All fees are in U.S. dollars and exclude taxes.
• You may pause or cancel your plan at any time from your account; cancellation takes effect at the end of the current billing period. We do not pro-rate or refund partial periods.
• Missed visits caused by inaccessible yards, holidays we publish in advance, severe weather, unsafe conditions, or factors beyond our reasonable control are not refundable and will not be made up.
• Chargebacks initiated without first contacting us in good faith may result in immediate termination of service and collection of unpaid balances plus reasonable costs.

If we genuinely miss a scheduled scoop, contact us within 48 hours and we will, at our sole option, return to complete the visit or credit the visit to your next bill. This limited remedy is your exclusive remedy for missed visits and is offered in lieu of any other warranty.

Dog waste may contain bacteria, parasites, viruses, and other pathogens. You acknowledge that Wastewag is not a public-health authority and cannot eliminate every contaminant from your yard. PoopCheck is not a screening test for parasites, infection, toxin exposure, dietary deficiency, cancer, or any disease. You assume all risks associated with your dog, your yard, and your interpretation of any Wastewag output.

• Do not use the Service to harass technicians, impersonate another customer, or request entry to a property you do not control.
• Do not scrape, resell, reverse-engineer, or build a competing dataset from our photos, scores, or AI outputs.
• Do not share PoopCheck links publicly in a way that could embarrass other households; share links are unique and revocable.

All Wastewag marks, the wordmark "Wastewag," "PoopCheck," the website, the AI prompts, software, and proprietary scoring methodology are owned by Wastewag. We grant you a limited, revocable, non-transferable license to use the Service for personal, household, non-commercial use.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTY OF VETERINARY OR MEDICAL SUITABILITY. WASTEWAG SPECIFICALLY DISCLAIMS ANY REPRESENTATION THAT POOPCHECK CAN DETECT, RULE OUT, OR PREDICT ANY ILLNESS OR CONDITION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WASTEWAG'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, IS LIMITED TO THE AMOUNT YOU PAID WASTEWAG IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER. WASTEWAG WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOSS OF DATA; VETERINARY OR EMERGENCY-CARE COSTS; LOSS, INJURY, ILLNESS OF, OR DEATH OF AN ANIMAL; LOSS OF ENJOYMENT; OR PROPERTY DEPRECIATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to defend, indemnify, and hold harmless Wastewag, its owners, employees, contractors, technicians, and suppliers from any claim, demand, damage, loss, or expense (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) any injury, illness, or death of any animal on your property, (c) reliance on PoopCheck or other Wastewag output in lieu of veterinary care, (d) any condition of your property, (e) your dog's behavior toward our technicians, or (f) your violation of any law.

Please read carefully — this section affects your legal rights. Any dispute arising out of or related to these Terms or the Service will be resolved by binding individual arbitrationadministered by JAMS in Orange County, California under its Streamlined Arbitration Rules. You and Wastewag each waive any right to a jury trial and to participate in a class action, class arbitration, or representative proceeding. You may opt out of arbitration by emailing hello@wastewag.com within 30 days of first accepting these Terms. Small-claims actions in Orange County are allowed.

These Terms are governed by the laws of the State of California, excluding its conflict-of-laws rules. For any dispute not subject to arbitration, exclusive venue lies in the state and federal courts located in Orange County, California.

We may suspend or terminate service immediately for non-payment, unsafe conditions, harassment of staff, or breach of these Terms, with no refund. Sections 3, 5, and 9–15 survive termination.

We may update these Terms by posting a revised version. Material changes will be highlighted on this page or emailed. Continued use after the effective date constitutes acceptance.
